By accessing and using the Nexiqs website and services ("Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Nexiqs provides a premium fishing community platform that connects anglers across Canada. Our services include:

• Access to fishing community forums and discussions
• Fishing spot maps and location database
• Educational content about ethical fishing practices
• Leaderboard and achievement tracking
• Premium membership benefits and features
• Service provider directory and recommendations

3. User Accounts and Registration

To access certain features of our Platform, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Membership and Subscription

Premium membership is offered at $12 CAD per month and includes enhanced features as described on our subscription page. You agree that:

• Subscription fees are billed monthly and are non-refundable except as required by law
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• We reserve the right to modify subscription prices with 30 days notice
• Access to premium features ends when subscription expires or is cancelled

5. User Conduct and Content

As a member of the Nexiqs community, you agree to:

• Follow all applicable fishing laws and regulations
• Practice ethical fishing methods and conservation principles
• Respect other community members and maintain civil discourse
• Provide accurate information when submitting catch reports or leaderboard entries
• Not share content that is harmful, offensive, or violates others' rights
• Not use the Platform for commercial purposes without prior written consent
• Not attempt to gain unauthorized access to Platform systems or data

6. Leaderboard and Catch Verification

Participation in our leaderboard system requires:

• Photo documentation of catch with clear weight verification
• Accurate location and date information
• Compliance with catch and release practices where indicated
• Adherence to local fishing regulations and seasons
• Truthful representation of catch circumstances

We reserve the right to verify, reject, or remove any leaderboard entries that cannot be substantiated or violate these terms.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Nexiqs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain rights to content you create and share on the Platform, but grant Nexiqs a non-exclusive license to use, display, and distribute such content in connection with Platform operations.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Platform, to understand our practices regarding the collection and use of your personal information.

9. Safety and Liability

Fishing activities carry inherent risks. By using our Platform:

• You acknowledge and assume all risks associated with fishing activities
• You agree that Nexiqs is not responsible for accidents, injuries, or losses
• You will exercise proper judgment regarding weather, water conditions, and safety
• You will follow all applicable safety regulations and recommendations
• You will not hold Nexiqs liable for the accuracy of fishing location information

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

In no event shall Nexiqs be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Platform.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ontario.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through prominent notice on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

14. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Platform ceases immediately.
